一般條款及細則

 

1.   服務

 

1.1  我們是騰創醫療服務有限公司(以下簡稱為「我們」、「本公司」或「iMeddy」)，且我們擁有及經營網站。我們的網站透過互聯網（包括透過使用應用程式或軟件）提供便利的購物模式。

 

1.2  閣下使用網站，即代表閣下同意受下列條款及細則所約束。請細閱有關條款及細則。

 

1.3  我們保留一切權利，可不時更改本條款及細則，而無需作出任何事前通知。修改後的條款及細則由發佈日開始生效。閣下持續使用我們的網站及我們的服務，即視為閣下同意接受本條款及細則的最新版本。

 

 

 

2.   註冊

 

2.1  閣下須於使用服務或作出訂購時向我們註冊。透過註冊，即表示閣下聲明（而我們有權據此依賴有關聲明）閣下年滿18歲或以上，並有構成具法律約束力合約的能力。

 

2.3  鑒於閣下使用我們的服務，閣下同意：

 

2.3.1 於填寫註冊表格時提供有關閣下的真實、準確、最新及完整的資料；及

 

2.3.2 保持及即時更新閣下的註冊資料以確保有關資料真實、準確、最新及完整。如我們有合理理由懷疑任何資料屬不實、不準確、並非最新或不完整，我們有權暫停或終止閣下的註冊。

 

 

3.   價格及付款

 

3.1  我們將採取一切合理商業努力以於我們的網站顯示準確及最新價格。然而，由於各類銷售商品的價格通常由供應商更新，故我們於接納閣下的訂單前無法列出確實的價格。

 

3.2  如商品的價格於我們擬接納閣下訂單時高於閣下作出訂購時的價格，則我們將

 

3.2.1 取消閣下的訂單，或

 

3.2.2 聯絡閣下，以諮詢閣下是否有意支付較高價格或取消閣下的訂單。

 

3.3  如我們取消訂單，而閣下已作出任何付款，則我們將向閣下退回我們於閣下的信用卡所扣減的任何金額。閣下同意及接納我們毋須就閣下的不滿而作出任何賠償。

 

3.4  我們使用第三方付款服務以進行網上交易。當閣下作出訂購時，閣下同意及接納，受其條款及細則所限，閣下的信用卡資料將會被我們以及付款服務供應商收集、處理及保留。閣下同意及接納，閣下單獨及獨自承擔閣下於進行信用卡交易時所招致或產生的任何損失，且我們於任何情況下均毋須承擔任何有關全部或部分損失。

 

4.   送貨

 

4.1  除於農曆新年首兩天及當八號或以上颱風警告信號或黑色暴雨警告生效時外，我們由星期一至日僅於香港的特定地區送貨。我們現時並無向偏遠地區及離島，及並無升降機設備的樓宇送貨。我們保留全權決定拒絕送貨的權利。閣下同意及接受，閣下會從我們的物流中心收取已訂購的商品，於任何情況下我們均不會接受取消訂單或向閣下退款。

 

4.2 我們會將閣下訂購的商品透過我們的職員或第三方供應商送遞閣下所提供的送貨地址。當閣下確認收到商品同時，閣下同意應要求出示具有照片的身份證明。當商品送遞至閣下所提供的送貨地址，商品被視為交付予閣下及由閣下接收。倘閣下因任何原因而未能接收商品，閣下同意及接受我們有權選擇向閣下收取額外費用或取消閣下訂購而無需退款或作出任何補償。

 

4.3  除另有規定外，我們將使用所有合理商業努力於接受閣下訂單的60小時內送貨。根據事先網上安排，閣下於訂購時或可選取任何一個可選擇的送貨時段。

 

4.4  當閣下所購商品已送交閣下，閣下將成為商品的擁有人。當商品已送交閣下，閣下將自行承擔持有商品的風險而我們將無須為它們的損失或損壞負責。

 

 

5. 免責聲明及責任限制

5.1  我們並不聲明或保證進入我們的網站(包括使用手機應用程式或軟件)或其任何部份將不受阻擾、可靠或並無故障。

 

5.2  我們並不向閣下聲明或保證我們的網站或其任何內容將為準確、完整或可靠。

 

5.3  我們並不聲明或保證：

 

5.3.1 任何服務(不論是否由我們提供) 將以適當謹慎及技巧提供；或

1.   Services

 

1.1  We areTech Creation Medical Service limited (collectively "we", the"Company" or "iMeddy") and we own and operate the siteincluding by using our applications or software (“services”).

 

1.2  By usingour site you agree to be bound by the following terms and conditions. Pleaseread them carefully.

 

1.3 We reserve the rightto make changes to these terms and conditions from time to time withoutproviding any prior notification. The amended terms and conditions areeffective from the date they are published on our site. Your continued accessand use of our site and our services shall represent your unconditionalacceptance of the latest version of the terms and conditions.

 

 

2.   Registration

 

2.1  You arerequired to register with us when you use the services or place an order. Byregistering you are making a statement, upon which we are entitled to rely,that you are aged 18 years or above and capable of forming a legally bindingcontract.

 

 

2.3  Inconsideration of your use of our services, you agree to:

 

2.3.1 provide true,accurate, current and complete information about yourself when filling out ourregistration form; and

 

2.3.2 maintain andpromptly update your registration information to keep it true, accurate,current and complete. If we have reasonable grounds to suspect that anyinformation is untrue, inaccurate, not current or incomplete, we have the rightto suspend or terminate your registration.

 

 

3.   Priceand Payment

 

3.1  We willuse all reasonable commercial endeavors to display accurate and up to dateprices on our site. However, because prices of the type of merchandise for saleare often updated by the supplier we cannot state the definite price until wesend you our acceptance of your order.

 

3.2  If theprice of the merchandise is higher at the time we are ready to send ouracceptance of your order to what it was at the time you placed your order thenwe will either:

 

3.2.1 cancel yourorder, or

 

3.2.2 contact youto ask you whether you wish to pay the higher price or cancel your order.

 

3.3  If theorder is cancelled by us, if you have already made any payment, we will make arefund on any sum deducted by us from your credit card. You agree and acceptthat we will not be obliged to offer any compensation for disappointmentsuffered.

 

3.4  We usethird party payment services to process online transactions. When you place anorder, you agree and accept that your credit card information will becollected, processed, and kept by us and a payment service provider subject toits terms and conditions. You agree and accept that you are solely andexclusively responsible for any losses incurred or sustained by you in makingcredit card transactions, and in no event shall any such losses in whole or inpart be borne by us.

 

4.   Delivery

 

4.1  We onlymake deliveries in the specified areas of Hong Kong from Monday to Sundayexcept on the first two days of the Lunar New Year and when typhoon warningsignal No. 8 or above or black rainstorm warning is in force. We currently donot make deliveries to remote areas and outer islands, and buildings withoutelevator facility. We reserve the right to decline delivery at our solediscretion. You agree and accept that you will collect your ordered merchandisefrom our logistics centre and under no circumstances will we acceptcancellation of order or refund.

 

4.2  We willdeliver the merchandise ordered by you to the address you give us for deliveryat the time you make your order through our staff or a third party provider.You agree to present your photo identification upon request when youacknowledge receipt of the merchandise. The merchandise shall be, and shall bedeemed to be, delivered and accepted by you when the merchandise are deliveredto the address you give us for delivery. You agree and accept that we areentitled, at our option, to charge you additional costs or cancel your orderwithout any refund or compensation to you in the event of your failure toaccept delivery for whatever reasons.

 

4.3  Unlessotherwise specified, we will use all reasonable commercial endeavors to makedelivery within 60 hours after your order is accepted. Subject to prior onlinearrangement, you may be offered to select from any one of the deliverytimeslots available at the time you make your order.

 

4.4  You willbecome the owner of the merchandise you have ordered when they have beendelivered to you. Once merchandise has been delivered to you they will be heldat your own risk and we will not be liable for the loss or damage.

 

13. Disclaimer ofWarranties and Limitation of Liability

 

5.1  We donot represent or warrant that access to our site (including using ourapplications or software), or any part of it, will be uninterrupted, reliableor fault-free.

 

5.2  We donot represent or warrant to you that our site or any of its contents will beaccurate, complete or reliable.

 

5.3  We donot represent or warrant that:

 

5.3.1 any services(whether or not provided by us) will be provided with due care and skill;
